Please read these Terms carefully. They include an assumption of risk and release of liability that limits the rights you would otherwise have if you are injured, become ill, or suffer loss in connection with our portal or any event. By using the portal or attending an event you agree to these Terms.

1. About these Terms

These Terms & Conditions ("Terms") are a legal agreement between you and Gold Coast Pride Official("GC Pride", "we", "us", "our"). They apply whenever you access this portal, create an account, register for or attend any event, activity, meet-up or program promoted through the portal ("Events"), or otherwise interact with us. If you do not agree, please do not use the portal or attend our Events.

2. The Portal

  • You must provide accurate information when creating an account and keep it up to date.
  • You are responsible for the security of your account and anything that happens under it.
  • You must not misuse the portal — including by uploading unlawful, abusive, discriminatory, misleading or infringing content, or by interfering with its operation or security.
  • We may, at our discretion and without notice, suspend or terminate access to the portal or any Event, including for breach of these Terms or our Code of Conduct.
  • The portal is provided "as is". We do not warrant it will be uninterrupted, error-free, or that information shown (including third-party listings, partner offers and event details) is current or accurate.

3. Events & Activities — Assumption of Risk and Release of Liability

Voluntary participation. All Events are voluntary. Many Events are organised and run by independent volunteer hosts, third-party venues and partners. You choose to attend at your own risk.

Acknowledgement of risks. You acknowledge that participation in wellness, fitness, social and outdoor activities involves inherent risks, including (without limitation) physical exertion, slips, trips and falls, collision with people or objects, weather and surf conditions, water-based activities, exposure to sun and heat, contact with other participants, the condition of venues and equipment, the actions or omissions of other attendees, travel to and from the Event, and the aggravation of pre-existing medical conditions. You voluntarily and knowingly assume all such risks, whether or not they are foreseeable.

Fitness to participate. You confirm that you are physically and medically fit to participate in any Event you attend. You are solely responsible for assessing your own ability, stopping if you feel unwell, and seeking medical clearance where appropriate. You must not participate while impaired by alcohol or drugs.

Release and exclusion of liability. To the maximum extent permitted by law, you release, indemnify and forever hold harmless Gold Coast Pride Official and its officers, employees, contractors, volunteers, hosts, sponsors, partners and affiliates (the "Released Parties") from and against any and all claims, demands, actions, suits, proceedings, losses, damages, costs and expenses of any kind (including legal costs on a full indemnity basis) arising out of or in any way connected with:

  • any personal injury, illness, disability or death;
  • any loss of, or damage to, your personal property;
  • any economic, consequential or indirect loss;
  • your attendance at, participation in, or travel to or from any Event, or your use of the portal or any equipment, facility, premises or service provided in connection with an Event,

whether caused by the negligence of a Released Party or otherwise, except to the extent such liability cannot lawfully be excluded.

Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.

4. Medical & Emergency

  • You must inform the host of any medical condition, allergy, injury or pregnancy that may be relevant before participating in an Event.
  • You consent to a host or representative of GC Pride calling for first aid, ambulance or emergency medical assistance on your behalf if they reasonably believe it is necessary, and you agree to be responsible for the cost of any such medical treatment or transport.

5. Photography & Media

Events may be photographed, filmed or live-streamed for community, promotional and social media purposes. By attending, you consent to being included in such media and to its use by GC Pride without payment. If you do not wish to be filmed or photographed, please tell the host on the day and we will use reasonable efforts to accommodate you.

6. Code of Conduct

Our community runs on respect. You agree to behave in a way that is safe, inclusive and respectful to everyone, and to follow any reasonable direction from a host or organiser. We may remove anyone from an Event or the portal whose conduct we consider unsafe, discriminatory, harassing or otherwise inappropriate.

7. Third-Party Venues, Partners & Discounts

The portal lists third-party venues, partner clubs, sponsors and member discounts. GC Pride does not own, operate or control these third parties. We are not responsible for their acts, omissions, products, services, premises, or for the accuracy or availability of any offer they make. Any dealing you have with a third party is between you and them.

8. User Content

You retain ownership of any content you submit to the portal (such as profile information, reviews, photos or messages). You grant GC Pride a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, display and use that content for the purpose of operating and promoting the portal and the community. You confirm you have the rights to grant this licence and that your content does not infringe anyone else's rights.

9. Privacy

We handle personal information in accordance with the Australian Privacy Principles. We collect the information necessary to run the portal and the Events you attend, and we do not sell your personal data. If you have a privacy question, contact us at the address below.

10. Changes to these Terms

We may update these Terms from time to time. The current version (shown above) applies whenever you use the portal or attend an Event. If we make a material change, we will ask you to accept the updated Terms the next time you RSVP.

11. Governing Law

These Terms are governed by the laws of Queensland, Australia. You and Gold Coast Pride Official submit to the exclusive jurisdiction of the courts of Queensland, Australia.

12. Severability

If any part of these Terms is found to be unenforceable, the remainder continues in full force. A waiver of any provision must be in writing to be effective.
